Situation

The client reached out to Radiant shortly before signing the Arras contract on a new-build property in Hospitalet. They had already made an offer and were preparing to commit to the transaction.

We were brought in late in the process to review the documentation, the contract, and the commercial conditions before any binding signature.

Initial findings

The buyer-side review immediately surfaced major issues. A large portion of the required documentation was missing or had not been provided in usable form.

The Arras contract itself appeared to have been copied from another transaction. The property address was wrong, a parking space was included even though no garage existed in the building, and several annexes referenced in the contract were missing.

Commercial review

On the commercial side, the agency fees being charged were excessive for the type and stage of the transaction.

We renegotiated those fees before signature and brought the cost structure in line with what was reasonable for a new-construction purchase of this profile.

Contract signing support

Even after the pre-signing corrections, the contract still contained errors that only became visible during the signing session itself.

We stayed present through a three-hour review at signing, corrected the remaining contractual and factual errors live, and only allowed the buyer to sign once each item had been addressed.

Result

The purchase was completed successfully after documentation, financial terms, and contractual errors were corrected.

The buyer signed with full visibility on what they were committing to, with corrected annexes, an accurate property description, and a renegotiated fee structure.

Key takeaway

On a new-construction transaction, the documentation and the contract are not automatically reliable just because the developer is institutional. Buyer-side review at offer stage, at Arras stage, and at signing is what protects the foreign buyer.
